Apple Loses Case

As of the Apple iPhone 12 model, it was selling without a charger in the box. Upon this situation, Apple was sued in Brazil. Apple lost the case. Here are the details…

In the past years, Apple has decided not to include the charging adapter and headset in the iPhone 12 boxes. They explained that the reason for this is to reduce the use of plastic. Apple used the recycling theme throughout the launch. In addition, the headset and adapter have been removed in the iPhone SE, XR and 11 versions. After this decision, there was a reaction from Apple users and possible future users. More than one lawsuit has been filed, mainly in Brazil. And the first of these cases was concluded.

Brazilian Mariana Morales Oliveira could not have the charging adapter out of the box after she bought the iPhone. Mariana Morales Oliveira then sued Apple. Mariana Morales Oliveira won the right to a charging adapter for the iPhone 12 with a court decision.

After the lawsuit, Rafael Quaresma, lawyer for Mariana Morales Oliveira, said, “Apple claimed at its launch that the use of plastic is a concern for the environment and protecting the world. What we’ve said and what the judge agrees is that this protection for the environment that Apple says it has is selective protection.”

”This is relative protection because the manufacturer has not stopped selling the accessory. It did not stop the production of the charging adapter. The only thing so far is that it doesn’t come with the device. However, you can still purchase it separately. This is somewhat pointless. Is it only the charging adapter that comes with the smartphone polluting the environment? Isn’t it a separate charging adapter?”made statements.

In addition, an important point as a result of the lawsuit is that the court determined that Apple will deliver a charging adapter to the consumer free of charge within 10 days. If Apple fails to comply with this decision, it will have to pay a daily fine of R $200 ($38). If he refuses to pay again, he is obliged to pay up to the money limit of R$5,000 ($956).

Do you think Apple is selling the charging adapter and earphones separately for recycling or to make strategic money? Totally strategic if you ask us.
